Privacy and Cookie Policy
1. INTRODUCTION
Your privacy is important to Jadea S.r.L.; we have therefore developed a Privacy Policy regarding how we collect, use, disclose, transfer, and store your data. We invite you to read this document to learn about our privacy protection criteria and to let us know if you have any questions.
Through this Privacy Policy, Jadea S.r.L., pursuant to Articles 13 and 14 of Regulation (EU) 2016/679 ("GDPR") and Italian Legislative Decree No. 101/2018, provides information regarding the processing of your personal data whenever you come into contact with Jadea S.r.L. or its subsidiaries in relation to the use of the Jadea website (www.Jadea.it), the online sales services of Jadea products, and the Jadea applications (hereinafter referred to only as the "App").
Our privacy rules explain:
- The data collected and its purposes;
- How such information is used;
- The options we offer, including how to access and update information.
This document has also been drafted taking into account the provisions of Directive 2002/58/EC, as updated by Directive 2009/136/EC, regarding cookies, and the provision of the Italian Data Protection Authority (Garante per la Protezione dei Dati Personali) "Identification of simplified procedures for information and acquisition of consent for the use of cookies" of May 8, 2014, the recommendations and clarifications provided by the Article 29 Working Party in "Opinion No. 2/2013 on applications for smart devices", as well as in "Opinion 13/2011 on geolocation services".
2. DATA PROCESSED
2.1 Data required for the use of the website and applications
Personal information is data that can be used to identify or contact a specific person, in order to offer better services to all our customers/users. You may be asked to provide your personal data whenever you come into contact with Jadea or a Jadea affiliate. Here are some types of personal data that Jadea might collect, and their related uses:
Access data collected anonymously
The computer systems and software procedures used to operate the website and all Jadea applications acquire, even without user registration, during their normal operation, certain personal data whose transmission is implicit in the use of Internet communication protocols. This information is not collected to be associated with identified data subjects, but by its very nature, through processing and association with data held by third parties, it could allow users to be identified.
This category of data includes the IP address or domain name of the device you use, the operating system, the device model and manufacturer, the mobile operator, the URI (Uniform Resource Identifier) addresses of the requested resources, the time of the request, the date and time of the visit, possibly the number of clicks, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error, etc.), and other parameters relating to the operating system and the IT environment of your device.
This data, collected anonymously through the use of cookies or web beacons, is used for the sole purpose of obtaining anonymous statistical information on the use of the application and the website and to monitor its correct functioning.
Traffic data
We may automatically collect the following categories of information when you visit our website or applications:
1. IP addresses;
2. Domain servers;
3. Types of computers accessing the website;
4. Types of web browsers used to access the website;
5. Referring websites or sources directing users to the website;
6. Other information associated with the interaction of the browser and the website/app with the installed systems (collectively "traffic and/or system usage data").
We do not link non-personal information from traffic data to personal information without your consent, except in connection with our marketing, promotional, or similar initiatives carried out alone or jointly with our business partners and affiliates.
Data provided voluntarily by the user
If you choose to register by creating your own account to use the online sales website and Jadea applications, we ask you to send and/or provide certain personal information by which you can be personally identified, including your first and last name, email address, year of birth, tax code (codice fiscale), username and password, telephone number, and postal address, which are necessary for the creation and management of customer/user accounts and records (hereinafter "CRM"). The same data will be requested during online purchases.
The User is responsible for the accuracy of the personal information sent/provided to Jadea. In these cases, we will request your explicit authorization to process the data provided (for example, on the registration page or on the online shop page at the time of finalizing the order).
Note: Jadea will not process any data communicated by the User that has not been expressly requested. Unsolicited information will be immediately deleted.
Location data
When you use the applications, the online shop, and Jadea services, we may collect and process information about your location. If you activated the use of geolocation services at the time of installing the application and if you expressly consented to the processing of geolocation data, the application, when active, will acquire data relating to the geographic position (GPS, Wi-Fi, GSM network).
Given that geolocation is not necessary for online purchases, you can subsequently decide to deactivate the geolocation services of your device at any time by accessing the specific location permissions section of your device's operating system (Android or iOS). From that moment on, the application will no longer be able to collect geolocation data for the use of the service.
If you did not activate the geolocation services at the time of installation, if you did not consent to the processing of geolocation data at the time of registration, or if you decide to deactivate geolocation services, you will not be able to use certain functions of the applications.
Information we collect from third parties
We may also collect information about you from third parties, including information from our partners (Jadea s.r.l.) and other partners; from social media services (including, but not limited to, Facebook, LinkedIn, Instagram, etc.) consistent with your settings on those services; and from third-party sources. We may add this information to the data we already have on file and share it with others in accordance with this Policy.
The provision of registration data is optional (Art. 6(1)(b) and (e) GDPR); however, failure to provide it may prevent your registration, the use of the functionalities of the applications and the Jadea account, as well as purchases on the online shop (Article 7 GDPR). Jadea and its affiliates may share this data with each other and use it in accordance with this privacy policy. They may also combine it with other data to provide and improve products, services, content, and advertising materials. You are not required to provide the personal data requested by us; however, if you choose not to provide it, in many cases we will not be able to offer you our products or services or accept your orders. The data could be used to ascertain criminal liability, where requested by the competent authorities.
3. PURPOSES OF PROCESSING AND LEGAL BASES
The legal basis of the processing refers to the source/origin/justification of the processing following the consent provided by the data subject in accordance with Article 4 of the GDPR, or other statutory grounds.
3.1 Your data will be processed based on:
- Execution of a Contract (Article 6(1)(b) GDPR): For managing orders, delivering products, and creating the account. Provision is necessary; otherwise, we cannot fulfill the order.
- Compliance with Legal Obligations (Article 6(1)(c) GDPR): For billing, invoicing, and tax obligations.
- Consent of the Data Subject (Article 6(1)(a) GDPR): For marketing, profiling, and geolocation purposes. Consent is optional and revocable without affecting your purchases.
- Legitimate Interest (Article 6(1)(f) GDPR): For website security and, limited to the email address provided during a purchase, for sending communications regarding similar products (so-called Soft-Spam), unless you object.
In relation to these purposes, the legal basis for processing is the performance of a contract to which the data subject is a party, the implementation of pre-contractual measures taken at the request of the data subject, or the satisfaction of a request made by the data subject.
3.2 Jadea S.r.L. will process your data subject to your specific consent. In relation to these purposes, the legal basis is the consent of the data subjects. Consent to the processing of personal data is purely optional. Failure to provide consent for optional processing activities (such as marketing, profiling, or geolocation) will not affect your ability to purchase products, but may limit access to certain optional features and services. Consent for marketing purposes remains entirely optional.
3.3 Jadea S.r.L. may also use user information (which may include personal data) for the following purposes.
Personal Data
• The personal data we collect allows us to keep you updated on Jadea’s latest product announcements, software updates, offers, promotions, and upcoming events. If you do not want to be included in our mailing list, you can opt-out at any time.
• We also use personal data to help us develop, deliver, and improve our products, services, content, and advertising, as well as for loss prevention and anti-fraud purposes.
• Personal data, including date of birth, may be used to verify identity, assist with user identification, and determine appropriate services. For example, date of birth may be used to determine the age of Jadea ID account holders.
• From time to time, we may use your personal data to send important notices, such as communications about purchases and changes to our terms, conditions, and policies. Because this information is important to your interaction with Jadea, you may not opt-out of receiving these communications.
• We may also use personal data for internal purposes, such as auditing, data analysis, and research to improve Jadea’s products, services, and customer communications.
• If you enter into a sweepstakes, contest, or similar promotion, we may use the data you provide to administer those programs. Furthermore, in order to provide our services to the customer/user, it is necessary for the user to make the required personal information available. If the user does not share their personal information with us, we will not be able to provide our products or services.
We will only collect information that is necessary for specified, legitimate, and explicit purposes, and the data and information provided will not undergo further incompatible processing. The information collected will be of the following types (which may or may not be personal information):
• Device information: Data related to hardware, performance, status, and device settings.
• Information provided or uploaded by the user: We may collect personal information provided by the user, such as Jadea account details.
Non-Personal Data
Data collected in an anonymous form, or which is in a format that does not, by itself, permit direct association with a specific individual—such as, by way of mere example, occupation, language, zip code, area code, unique device identifier, referral URL, location, and the time zone where a Jadea product is used—is collected, used, transferred, and disclosed by us for any purpose whatsoever, in order to better understand customer/user behavior and improve our products, services, and advertising.
4. RETENTION PERIOD
Your data will be processed for the duration of the contractual relationship and/or for as long as the account remains active, as well as for the period required by tax and fiscal laws. With reference to personal data processed for Marketing Purposes, the data will be retained in compliance with the principle of proportionality and, in any case, until the purposes of the processing have been pursued or until—if earlier—the specific consent is revoked by the data subject.
5. PROCESSING METHODS AND THEIR USE
5.1 Processing
Data will be processed, ensuring the necessary security and confidentiality, through the following methods: collection of data from the data subject, collected and recorded for specified, explicit, and legitimate purposes and used in further processing operations in terms compatible with those purposes; processing carried out with the aid of electronic and automated tools (collection of data via telematic means, directly from the data subject).
The processing of data is based on principles of correctness, lawfulness, and transparency in compliance with the GDPR. It may be carried out either manually or through automated methods suitable for storing, managing, and transmitting the data. It will take place through technical and organizational measures appropriate to the state of the art to ensure, among other things, the security, confidentiality, integrity, availability, and resilience of systems and services, avoiding the risk of loss, destruction, unauthorized access or disclosure, or otherwise unlawful use. Reasonable measures will also be taken to promptly delete or rectify data that is inaccurate with respect to the purposes for which it is processed.
Access to data
Your data may be made accessible for the purposes referred to in Article 3 to:
1. Employees and collaborators of Jadea or Group companies in Italy and abroad, in their capacity as authorized persons and/or internal data processors and/or system administrators;
2. Third-party companies or other entities (by way of indication, credit institutions, professional firms, consultants, insurance companies for the provision of services, etc.) that perform outsourcing activities on behalf of Jadea, in their capacity as external data processors.
Communication of data
Without the need for express consent (pursuant to Article 6(1)(b) and (c) GDPR), Jadea may communicate your data for the purposes referred to in Article 3 to Judicial Authorities, as well as to those subjects to whom communication is mandatory by law for the fulfillment of the said purposes. These subjects will process the data in their capacity as independent data controllers.
Data Transfer
Our registration data may be stored on your devices and on the servers supporting Jadea applications. Personal data is stored on servers located within the European Union. It remains understood that Jadea, as Data Controller, shall have the right to move the servers even outside the EU, if necessary. In such case, the Data Controller ensures as of now that the transfer of data outside the EU will take place in accordance with applicable legal provisions, subject to the stipulation of the Standard Contractual Clauses (SCC) provided by the European Commission or other approved mechanisms.
6. RECIPIENTS OF THE DATA
6.1 Your data will be processed by employees and collaborators of Jadea S.r.L. who perform activities related to the pursuit of the aforementioned purposes. These employees have been designated as persons authorized to process the data and have received adequate operating instructions in this regard.
6.2 Jadea shares users' personal data with companies that provide services such as data processing, data storage, fulfillment of customer/user orders, home delivery of products, management and enhancement of customer/user data, customer/user assistance, assessment of interest in our products and services, and market research or user satisfaction surveys. These companies are obligated to protect your data and may be located anywhere Jadea operates.
7. YOUR RIGHTS
In relation to the processing of personal data carried out by Jadea, you may request access to your Personal Data, the rectification or erasure thereof pursuant to Article 17 GDPR, the completion of incomplete data, and the restriction of processing.
You may also request to receive the Data in a structured, commonly used, and machine-readable format, as well as, if technically feasible, to transmit them to another controller without hindrance, provided that the conditions for exercising the right to data portability pursuant to Article 20 of the GDPR are met (i.e., the processing is based on consent pursuant to Article 6(1)(a) or Article 9(2)(a), or on a contract pursuant to Article 6(1)(b) of the GDPR, and is carried out by automated means).
You have the right to withdraw the consent given at any time for the purposes referred to in the previous Art. 3 and to object, in whole or in part, to the processing in permitted cases; to lodge a complaint with the Supervisory Authority, as well as to exercise the other rights recognized by the applicable discipline (Arts. 16-21 GDPR).
These rights can be exercised by sending a written communication to the address indicated below or an email to: privacy@Jadea.it, as well as by using the access tools available within each application.
You also have the right to lodge a complaint with the Supervisory Authority (Garante Privacy – www.garanteprivacy.it).
8. USE OF COOKIES AND COOKIE POLICY
Jadea and its partners use various technologies to collect and store information when the Jadea website is visited or Jadea services and applications are used, which may involve the use of cookies, web beacons, pixel tags, or similar technologies to identify the user's browser or device. We also use these technologies to collect and store information when the user interacts with services we offer to our partners, such as advertising services or Jadea application functions that may appear on other sites.
Cookies
We use cookies to personalize your experience on the Jadea website and app and, where applicable, to remember your login credentials so you do not have to re-enter them each time you visit the site or access the App. "Cookies" are small files transferred to your computer's hard drive that contain information such as user ID, user preferences, pages visited, and activities performed while using the sites. We do not link the information stored in cookies to any of your personal information submitted on the sites.
You can block cookies or delete cookies from your hard drive; however, by disabling cookies, you may not be able to access all features of the sites or applications. Some of our business partners and affiliates also use cookies to provide anonymous data and information regarding the use of the sites, applications, and our services. We do not have access to or control over these cookies; our privacy policy does not cover the use of such cookies. Some of our business partners (e.g., licensees and sponsors) may use cookies on our Site (in advertising banners) or on their sites accessible from ours via links. We have no access to nor can we control these cookies. You are not obliged to accept cookies from us or any other website, and you can set your browser not to accept cookies, although in this case, some functions of the Site may not be available.
Web Beacons
Jadea or our tracking utility company also uses "web beacons" to collect information about your use of our sites and apps, your use of sponsor sites, and your use of emails, special promotions, or newsletters that we send. Web beacons are tiny graphic files embedded in a web page or an email that allow us to determine whether a webpage or email has been viewed and send information back to the home server from the user's browser.
The information collected by web beacons allows us to statistically monitor how many people open our emails, use our sites and services, and affiliate, sponsor, and advertiser sites and communications, and for what purposes. Our web beacons are not used to track your activity outside of our sites or applications or those of our affiliates or sponsors. We do not link personal information from web beacons to personal information without your consent, except in connection with our marketing, promotional, or similar initiatives carried out alone or jointly with our business partners and affiliates.
9. INFORMATION NOT CONTAINED IN THIS POLICY

10. CHANGES TO THIS PRIVACY POLICY
Jadea, as Data Controller, reserves the right to make changes to this privacy policy at any time by giving notice to Users on this page. Therefore, please consult this page often, referring to the date of the last modification indicated at the bottom. In case of non-acceptance of the changes made to this privacy policy, the User is required to cease using this Application and may request Jadea to remove their Personal Data. Unless otherwise specified, the previous version of the Privacy Policy shall continue to apply until the changes take effect.
